Terms of Service

These terms cover the service Dymify provides at dymify.com. Dymify is operated by Brian Mann, a sole proprietor in Seattle, WA. Using this site or engaging the service means you accept these terms.

1. What the Service Is

I run paid Meta ads (Facebook and Instagram) for real estate teams. I also make the first contact on every inquiry the ads produce. The deliverable is booked buyer and seller appointments on your calendar. Each appointment goes to one client only. I do not resell a contact to another team.

2. What the Service Is Not

I do not run long-term nurture or drip campaigns past the booked appointment. I do not answer your inbound calls. Your agents attend the appointment, run it, and close it. Conversion at and after the appointment is your team's responsibility.

3. No Guarantee

I do not offer a performance guarantee, a volume guarantee, or a refund guarantee. I book appointments. I cannot guarantee that a prospect keeps one, or that your agent converts it. Results depend on your market, your budget, and how your team runs the appointment. Anyone promising a fixed number of deals is guessing.

If I do not think the service will work for your market, I will say so on the call rather than take the engagement.

4. Fees and Payment

The service fee depends on your market and your team size. I quote it on the call and confirm it in writing before any work starts. There is no published flat rate.

The service fee is billed monthly in advance. The specific payment method is agreed before the first invoice and stated on that invoice.

Ad spend is separate from the service fee. Ad spend is billed by Meta directly to the payment method on your own ad account. I never hold or mark up your ad budget.

5. Term and Cancellation

There is no long-term contract. Either side may cancel with written notice before the next billing cycle. Fees already paid for the current cycle are not refunded, because the ads run for that period.

On cancellation I stop the campaigns and hand over the assets described in section 6.

6. Ownership of Contacts and Assets

You own every contact I generate for you. They live in your CRM and stay there whether or not you continue. I do not retain a copy for resale or reuse.

Campaigns run on your Meta ad account wherever possible, so the account, the pixel data, and the audiences remain yours.

7. Your Responsibilities

You provide access to your ad account, CRM, and booking calendar, approve creative in writing, and fund your own ad spend. You confirm that your team is licensed and that your marketing claims are accurate.

You are responsible for complying with Fair Housing law and with your state's real estate advertising rules. I will not run creative that appears to violate either.

8. Platform Rules

Meta controls ad approval, account standing, and the Special Ad Category rules that apply to housing. Meta can reject creative or restrict an account at its own discretion. I cannot override those decisions and I am not liable for them.

9. Limitation of Liability

My total liability is limited to the service fees you paid in the three months before the claim. I am not liable for lost profits, lost deals, or indirect damages.

10. Confidentiality

I keep your performance data, cost figures, and internal details private. I will not name you as a client publicly without your written permission.

11. Changes

I may update these terms. Material changes are posted here with a new date. Continued use of the service after a change means you accept it.

12. Governing Law

These terms are governed by the laws of the State of Washington.
